You shall cooperate as fully as reasonably required in the defense of any claim. Sehi reserves the right, at its own expense to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of Sehi Computer Products, Inc.

The Company web site contains links and pointers to other related World Wide Web internet sites, resources, and sponsors of the Company web site. Links to and from Company web site to other third party sites, maintained by third parties, do not constitute an endorsement by Sehi or any of its subsidiaries or affiliates of any third party resources, or their contents.

SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATES OF MICHIGAN AND/OR CALIFORNIA.

This Agreement constitutes the entire agreement between Sehi and you with respect to your use of the Company web site. Any cause of action you may have with respect to your use of the Company web site must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of the Agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the Agreement, and the remainder of this Agreement shall continued in full force and effect. Company disclaims any and all responsibility for content contained in any third party materials provided through links from the Company Interact site.

Important Credit Card Information
If you are ordering with a credit card, your shipping address must be the same as the billing address of your credit card statements for new retail and business customers. This is for your protection. If you are mailing to your office or work address you must notify the credit card company to allow shipments to be sent to this address. This is an easy process... simply call the credit card company and requests multiple shipping addresses. Your order will not pass authorization if we cannot verify your shipping address.

Sales
Sehi sells to all types of customers - business, commercial, enterprise, personal, retail, educational, governmental, federal, non-profit - within the United States. We may have limitation on some product lines prohibiting us to sell to resellers. If you experience an issue with a product, most products have a 30 day return policy from date of invoicing. A re-stocking fee may be charged and all the original packaging is required. A RMA number is also required prior to sending any goods to Sehi. If returned goods are received at Sehi without an RMA number assigned to it and referenced on the shipping label, Sehi will refuse the shipment and it will be shipped back to you. Sales Tax
Sales tax is only required for orders shipping into states where we have or may have nexus for state tax purposes under applicable laws. Therefore all orders shipping into California, Michigan and Arkansas will be charged applicable sales tax according to the tax rate of the SHIPPING ADDRESS. If you are picking up product from one of the Sehi locations, your tax rate will be based on the tax rate for that particular location.

Processing Time
You can expect your order to be processed and shipped approximately same day/24 hours, provided the items are in stock and there are no problems with payment verification. buysehi.com does not guarantee same day-shipping, however we make every attempt to completely process your order same day. Orders are not processed on weekends and holidays.

Rush Processing
buysehi.com will rush process your order provided that the following conditions are met:

  1. Order is submitted Monday – Friday (excluding holidays) before noon PST.
  2. Your transaction and credit card authorization is successfully completed at time of order placement.
  3. Rush Processing does NOT apply to Pre-Paid Check orders unless preapproved by Sehi

Backorders
buysehi.com lists our entire inventory of items we can sell to you. On rare occasions, some products may be backordered due to heavy order volumes, manufacturer delay, etc. You may check the status of your order anytime by either visiting your My Account page or Contact Us.

Orders
An order is not binding upon buysehi.com until it is accepted; buysehi.com must receive payment before it will accept an order unless prior arrangements have been made on your account (purchase orders, etc.). Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with buysehi.com. You agree to pay the amount(s) due as specified on the invoice.

Order Status
buysehi.com will keep you informed of your order status via e-mail. All tracking information will be emailed to your buysehi.com registered email once your order has shipped. You may also acquire your order status and other live updates by logging in to your account.

Cancellation Policy
Most orders ship within 24 hours of receiving them. We can not cancel an order that has already been shipped. If contacted before product has shipped we would be happy to work with you. You may request that an order be cancelled provided the order has not already been processed and shipped. To request cancellation, simply call 888.BUYSEHI (888-289-7344) Monday thru Friday 8am-5pm PACIFIC time excluding holidays. 

You will receive a credit for the full amount to your credit/debit card in approximately 1-5 business days once we successfully cancel your order. We strongly discourage sending order cancellation requests via email because it is unlikely we will receive the message in time to void the order due to the sheer volume of emails we receive each day and how quickly we process/ship orders.

International Orders
We are unable to accept credit cards issued by banks outside of the United States. Sorry but we do not take or ship International orders.

Privacy Policy
All information gathered by us through your order is kept strictly confidential and will not be distributed to any company or individual. The information will be used only to make sure that your order gets delivered to you in the timeliest manner possible. If you need to change anything about your order please contact us. buysehi.com respects your privacy. We will not under any circumstances sell or release your information to anyone except as outlined in our privacy policy. All of the information obtained from our Web site will be used for processing purposes only. Shipping Policies
Most orders ship out within 1-2 days. Some items are special order. Special order items can take 2-3 weeks, sometimes longer, extra to ship from our office. You can always call to check on your order, but we ask that you be reasonable in your expectations of delivery.

Shipping Charges updated February 29, 2016
Your total cost for purchase of any product will include the shipping and handling charges shown on your buysehi.com invoice, if applicable. However, your original shipping fees are non-refundable in the case of a returned product. Those fees are paid for the services provided by and to the original carrier, and will not be refunded to you if your item is returned for a refund to buysehi.com. Orders below $500 will incur a flat $6 shipping charge for ground shipping within the contiguous United States. Additional shipping charges may apply if your item weighs more than 120lbs and/or is of an odd size/shape. You will be notified prior to shipping if your shipping charges may increase due to weight and/or shape. Orders over $500 that do not have an item(s) weighing more than 120lbs and/or are not of odd size/shape will receive free shipping within the contiguous United States. BenQ replacement projector lamp orders will be charged a minimum of $10 flat fee for shipping regardless of order total, weight, size and/or shape due to manufacturer requirement.

Risk of Loss
buysehi.com will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) -- excepting software -- and risk of loss passes to the Customer upon delivery to the carrier. buysehi.com reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow buysehi.com to sign appropriate documents on Customer's behalf to permit buysehi.com to protect its purchase money security interest. Title to software will remain with the licensor(s). All software is provided subject to the license agreement of the software maker. Customer agrees to be bound by any software license agreement once the seal on the package is broken. buysehi.com will advise Customer of estimated shipping dates, but buysehi.com will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes. 

Shipping
We normally ship all orders via UPS or FedEx Ground depending on weight. Sehi ships from the closest warehouse that has stock to your shipping address. Hawaii & Alaska will incur additional shipping charges due to the items are required to be sent via Air. Please contact us for a quote.

Shipping Methods

  • Standard ground shipping is free for orders over $500 within the contiguous United States generally, depending on the product purchased. Some heavier and/or odd shape/size items may require additional shipping
  • FedEx 2Day - Delivery within 2 business days - depending on availability of the product. Please contact us to verify. Orders must be received by 11am PST Monday-Friday, excluding holidays. Additional shipping charges will apply
  • FedEx Standard Overnight - depending on availability of the product. Please contact us to verify. Orders must be received by 11am PST Monday-Friday, excluding holidays. Additional shipping charges will apply
  • UPS Ground - 5 to 7 business days
  • For Hawaii and Alaska customers - FedEx can only ship via 2Day Air and the shipping time will not be guaranteed. Therefore, there will be additional shipping charges to your order
  • buysehi.com does not process orders during weekends
  • No deliveries will be made on Saturday or Sunday
  • buysehi.com does not guarantee same day shipping, however will make every attempt to ship your product out same day.
  • buysehi.com does not offer International/Canadian shipping options at this time.

Resellers
Unfortunately, we do not currently have a reseller or discount program available at this time and are unable to sell to resellers due to other contract obligations with various manufacturers. 

Electronic Waste Recycling Act (updated January 1, 2013)
The Electronic Waste Recycling Act ("Act") became law in California on January 1, 2005. The primary objective of this law is to initiate a recycling program for computer products containing chemicals deemed hazardous to the environment. To fund this program, California requires retailers and e-tailers to collect, on the state's behalf, a fee for each product covered by this law. The fee is paid by the consumer at the time of purchase of the covered product. This fee will be remitted directly to the state by and only applies to orders shipped within/to California.

The types of products that we are required to collect this recycling fee include cathode ray tubes, cathode ray tube devices, flat panel screens, and other similar video display devices. The actual amount of the recycling fee will vary, based on the screen size of the product when measured diagonally, as follows (rates below effective January 1, 2013 forward):

  • More than 4”, less than 15" measured diagonally -- $3.00  
  • Greater than or equal to 15" and less than 35" measured diagonally -- $4.00
  • Greater than or equal to 35" measured diagonally -- $5.00

For more information concerning the scope and details of the Act, please refer to the California Integrated Waste Management Board's website at http://www.calrecycle.ca.gov or to the Department of Toxic Substances Control's website at http://www.dtsc.ca.gov/HazardousWaste/EWaste/index.cfm.

Purchase Agreement
By accepting delivery of any product ordered from buysehi.com ("buysehi.com"), you ("Customer") agree to be bound by the terms and conditions listed below. You and buysehi.com agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and buysehi.com. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from buysehi.com.

IN ALL CIRCUMSTANCES buysehi.com 'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. buysehi.com SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. buysehi.com SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT buysehi.com HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Recordings
buysehi.com does not consent to having any telephone calls recorded and reserves the right to terminate any call that is being recorded. Customer agrees not to record any call with buysehi.com unless Customer has provided clear and conspicuous notice to buysehi.com and has received prior written consent from buysehi.com.

Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between buysehi.com and Customer shall be governed by the laws of the State of California, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. buysehi.com and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of California, Orange County, to resolve any dispute between them related hereto, and the parities waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against buysehi.com that is more than one year after the date of the applicable invoice.

Severability
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable California law.

Waiver
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement
These terms and conditions, together with buysehi.com's invoice regarding the products ordered by Customer, are the complete and exclusive agreement between buysehi.com and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between buysehi.com and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

SEHI RETURNS POLICY

We strive to provide our customers with the highest level of service possible. From first visit to order delivery, we want you to be completely satisfied with your experience. Our friendly and knowledgeable sales staff is available to help you find the product that is best for you. Every product we ship is factory-sealed and covered by the manufacturer's warranty.

Return Policy and Conditions

  • Dead On Arrival - All products received dead on arrival must be reported within 10 days of receiving product at shipping point. If Sehi is unable to authorize the return through the manufacturer, you may be referred directly to the manufacturer to utilize the warranty.
  • Damaged in Shipment - All products damaged in shipment must be reported to carrier within 48 hours. Sehi must also be contacted. Products that contain hidden damage must be reported to Sehi within 10 days of receiving product at shipping point.
  • Over Shipments - All products received as over shipments must be reported to Sehi within 10 days.
  • Duplicated orders - All orders that are shipped in duplication must be reported to Sehi within 10 days to avoid being billed for the additional shipment(s).
  • Customer Satisfaction - Customer satisfaction issues will be handled case by case. Customer Satisfaction varies by manufactures and previous purchases of each manufacture products. Sehi must be contacted within 10 days of receiving product in order to contact manufacturer and file a customer satisfaction request. Sehi cannot guarantee a full credit or return of a customer satisfaction issue. Sehi will, however, make our best effort to resolve all customer satisfaction issues. A restocking charge could be assessed.
  • Warranty Returns - Sehi follows and passes on all manufactures warranties. Policies differ for each manufacture and Sehi is held by the guidelines of the individual manufactures. All warranty issues must be reported to Sehi within 25 days of invoice date. Some products may require you to go directly to the manufacturer or to the nearest authorized service center. Most manufactures request that the end user contact the manufactures technical support directly so a diagnosis can be made and a case number given to the end user for warranty exchange, replacement or repair.
  • Requirements - Purchaser must obtain a valid Return Material Authorization (“RMA”) number from Sehi for all returns. RMAs will be issued, at Sehi’s sole discretion, in accordance with these terms and conditions. Purchaser must provide its account number and all other information as required by Sehi for all returns. RMAs are valid for twenty (20) calendar days from the date of issuance. Purchaser must allow for in-transit time for Products to be returned to Sehi, as Sehi must physically receive Products within the twenty (20) calendar days. RMAs will be issued for authorized returns under one of the following categories: (i) defective Products, (ii) stock balancing, (iii) billing or shipping discrepancies, or (iv) Damaged Product. Purchaser is responsible for ensuring that the RMA number is clearly visible on the address label of the Product packaging when it is returned to Sehi. Sehi will refuse delivery of any boxes without a valid, clearly visible RMA number as noted above. Overgoods are unauthorized returns. Any Products received by Sehi (i) without a valid RMA number, including Product shipments refused by Purchaser or Purchaser’s customer except those damaged in transit from Sehi to Purchaser or from Sehi to Purchaser’s customer, (ii) later than twenty calendar (20) days from the RMA date, or (iii) in a condition unsuitable for resale (excluding defective Products), will be considered Overgoods. Sehi will return Overgoods to Purchaser or Purchaser’s customer, and will charge Purchaser a $50 processing fee per shipment plus related freight charges. If Purchaser refuses the shipment of Overgoods from Sehi or returns the Overgoods to Sehi a second time without Sehi’s prior authorization, Purchaser agrees to relinquish all right and title to and waives all claims against Sehi for credit related to such Products. Notwithstanding anything to the contrary, Sehi reserves the right not to authorize the return of Products that are no longer in production or are being produced or published by a manufacturer or publisher that (i) is insolvent, (ii) has declared bankruptcy, or (iii) will not accept returns from Sehi.
  • Defective Product Returns - Defective returns are only for Products purchased from Sehi that are inoperable or do not function in accordance with the specifications published by the manufacturer or publisher and are covered under the manufacturer’s or publisher’s warranty. All defective returns are subject to more restrictive manufacturer or publisher policies. Purchaser may request an RMA for the return of defective Products, excluding Special Order Products, within twenty-five (25) calendar days of invoice date. Purchaser’s defective returns will be limited to a maximum of 15% of the value of Purchaser’s Product purchases within the same vendor code as the defective Product during the twenty-five (25) calendar days prior to the RMA date, less any prior defective returns during that period. Upon receipt of the defective Product for which the RMA was issued, Sehi may test the Products and may return to Purchaser, at Purchaser’s expense, any Products found not to be defective. Upon verification that the returned Product is defective, Sehi may, at Sehi’s sole discretion, either (i) repair the defective Product, (ii) ship Purchaser a replacement Product, or (iii) provide Purchaser a credit equal to the lesser of the Product’s invoice price or current replacement value less any applicable charges or fees. Sehi reserves the right to require Purchaser to return defective Products directly to the manufacturer or publisher for replacement according to its defective Products return policy. Sehi shall not be obligated to repair, replace, or issue credit to Purchaser for Products rendered defective, in whole or in part, by causes external to the Products, including, but not limited to, catastrophe, power failure or transients, overvoltage on interface, environment extremes, improper use, maintenance or application of the Products or use of unauthorized parts. Purchaser shall bear all risks of loss when returning defective Products.
  • Stock Balance Returns - Stock balance returns are only for Products purchased from Sehi that are unopened and unused and can be re-sold as new. All stock balance Products returned must be in the manufacturer’s original packaging and in condition suitable for resale including, but not limited to, without price tags or stickers or additional shrink wrapping, clean, undamaged and complete (“Stock Balance Condition”). All stock balance returns are subject to more restrictive manufacturer or publisher policies. Purchaser may request an RMA for the return of Products in Stock Balance Condition, except for Special Order Products, within thirty (30) calendar days of invoice date. Purchaser’s stock balance returns will be limited to a maximum of 15% of the value of Purchaser’s Product purchases within the same vendor code as the Product to be returned during the thirty (30) calendar days prior to the RMA date, less any prior stock balance returns during that period. Upon receipt of the Product for which the RMA was issued, Sehi will verify the condition of the Product. Any Products that are not in Stock Balance Condition will be considered Overgoods. Sehi will return Overgoods to Purchaser and will charge Purchaser a $50 processing fee per shipment returned to Purchaser plus related freight charges. Additional fees may apply to returned Products; e.g., re-box, label removal, reshrink, etc., that are not in Stock Balance Condition. Upon verification that the returned Product is in Stock Balance Condition, Sehi will issue a credit to Purchaser equal to the lesser of the Product’s invoice price or current replacement value less any applicable charges or fees. If Sehi elects to restore returned Product to Stock Balance Condition instead of returning it to Purchaser, the credit to Purchaser, the credit to Purchaser will be net of Sehi’s costs to return the Product to Stock Balance Condition. Purchaser shall pay all costs and bear all risks of loss when returning Products to Sehi.
  • Damaged Product Returns - Damaged Product returns are only for Products purchased from Sehi and shipped via Sehi’s carrier of choice that are damaged in transit from Sehi to the Purchaser or from Sehi to the Purchaser’s customer. Purchaser or Purchaser’s customer shall refuse any Product delivered in damaged condition. If the Product is received in damaged condition, Purchaser shall notify Sehi and request an RMA within three (3) business days of receipt of such Product. Failure to notify Sehi and request an RMA within such time shall be deemed an acceptance of the Product as of the date of shipment.
  • Restocking Fee - A minimum 15% restocking fee may be applied to all returns due to mistaken purchase, non-compatibility issues and/or any additional issues that could have been avoided and verified prior to purchasing the product. Shipping charges are non-refundable. If Sehi is charged a larger restocking fee from the manufacturer, the higher percentage will be passed along to you.

A RETURN AUTHORIZATION NUMBER (RA# or RMA#) must be obtained and is required for ALL returns. We reserve the right to charge a 15% restocking fee on returns. Merchandise must be returned within 15 days of the issuance of the RA# at which time the RA# expires. RA#'s are non-renewable. We reserve the right to return any merchandise without a valid RA# to the customer or to prorate the credit.

All returned merchandise must be in the original packaging with the UPC or bar code intact. All components, manuals, registration card(s), software, cables & accessories must be included. buysehi.com inspects all returns and reserves the right to return merchandise that does not meet the criteria.

If you are a corporate or government customer and would like access to our custom pricing please register if you have not done so yet. Then fax a sheet of letterhead with your name, address, phone numbers and email address to 949-498-1770. Please note that your email address must belong to the organization you are requesting custom pricing for. Hotmail, Gmail, yahoo, outlook, mail.com and other free emails addresses will not be accepted for governmental/educational level pricing.

Please note we try to assign new accounts to their respective pricing within minutes of registration during business hours of our California office. If you register during a holiday, weekend, or after hours your pricing will be applied immediately the following business day. You will receive an email confirmation once your pricing has been applied.
